A MEN ARRESTED FOR ILLEGALLY UPLOADING SUBTITLED MOVIES

Operation conducted by Kyoto Prefectural Police Headquarters Cyber Crime Division
and Fushimi Police Station
On July 5, 2016, police officers from Kyoto Prefectural Police Headquarters Cyber Crime Division and Fushimi Police Station conducted a search of the residence of the men. The police subsequently arrested the man on suspicion of illegally making and uploading subtitled copies of MPAA member company copyrighted movies in violation of the Copyright Act. This is the first case of its kind in Japan involving the illegal subtitling of foreign films.
The men are suspected of illegally translating the audio tracks of the films into Japanese, adding Japanese subtitles and uploading the files to the internet without the permission of copyright holders. He has admitted to the accusations.
In addition, another man was arrested on the same day for illegally making and uploading subtitled copies of MPAA member company copyrighted movies to the file share software “Perfect Dark” without copyright holders’ permission.
Commenting on the arrests, Mr. Takashi Anze, President of Motion Picture Translators Association, said, “The Japanese subtitled versions of foreign movies released in Japan were produced by the distribution companies, Japanese production companies and translators, each of whom devoted their expertise and energy to realizing the sense and meaning of the original films. To translators, each title is like their own child. We hope that all audiences can enjoy movies within the purview of the law.”
Mike Ellis, President and Managing Director Asia Pacific, Motion Picture Association (MPA), said “This is an important enforcement operation and we commend the work of the police authorities for bringing the case to a successful conclusion. Reducing the infringement of films and television shows online, along with educational campaigns and increasing access to a wide variety of legal online services will help ensure a vibrant and dynamic screen community that will benefit both filmmakers and consumers alike”
JIMCA initiated the investigation into the illegal subtitling activity, identified the website to which the illegal subtitled files were uploaded and engaged with the Kyoto Prefectural Police Headquarters Cyber Crime Division to pursue the investigation. JIMCA fully assisted the Police in their enquiries, working with the rights holders, examining illegal files, and providing logistical support.
JIMCA encourages a multi-pronged approach to reducing online infringement and creating a healthy digital ecosystem, including public education campaigns, promoting access to the many legal channels currently available, enforcement measures such as actions against illegal subtitling of movies, and legislative measures such as the introduction of disabling access to major pirate websites, an effective measure that is currently adopted by 40 countries around the world.

On April 26, 2016, Japan and International Motion Picture Copyright Association (JIMCA), with the support of the U.S. Embassy hosted a special screening of the feature
film “The Revenant” at TOHO Cinemas Roppongi to celebrate World IP Day. The film has received numerous accolades including an Academy Award for Best actor and director.
World IP Day is all about celebrating creativity and innovation. This year, the theme is “Digital Creativity: Culture Reimagined”.
In today’s digital environment, it’s vital to put in place effective digital copyright protection to safeguard the value of creative content.
Prior to the screening, Ms. Jessica Webster, Minister Counselor, Economic and Science Affairs, Embassy of the United States of America,
said to an audience of approximately 150, “I am delighted to be able to introduce The Revenant. You may know that The Revenant is
based on a novel by the U.S. Ambassador to the World Trade Organization Michael Punke. Ambassador Punke is a lawyer by training
but also a great outdoorsman who was inspired by the true story that became his novel. He may not be able to talk about
his own movie due to his role in the government, but I am glad that I can!
“In many ways, his film is such a fitting choice for World Intellectual Property Day. If anyone is a champion of protecting
intellectual property, it would be Ambassador Punke. He has built a distinguished career negotiating trade agreements,
which often include some discussion of how to create a policy environment that supports creativity and innovation.
“The film embodies the essence of today’s theme, which is about reimagining cultures and digital creativity
in a period of rapidly evolving technology
“We want to reward the entire production team for their talents and encourage them to continue taking risks and
investing in their art. Thinking about the cultural and intellectual influence of film, these artists are, at times,
also investing in their audiences and helping to shape public discourse. Yet less than a week before the movie was released,
someone posted it to the Internet, costing the studio a significant financial lost.
“These kinds of acts demonstrate the importance of protecting intellectual property, including copyrights,
with supportive policies that sustain jobs and motivate the next generation to pursue careers in this field.
For tonight, let’s let the film speak for itself about the value of artistic pursuit. Please enjoy The Revenant!

which provided the film for the event, said, “I am honored that “The Revenant”
has been selected as the feature film for World IP Day this year.
“This film was awarded three major Academy Awards. Leonardo DiCaprio won an Oscar for Best Actor to show
he was a superstar both in name and in reality. Alejandro Gonzalez Inarritu accepted the Oscar for Best Director
for the second consecutive year while Emmanuel Lubezki won the Academy Award for Best Cinematography
for the third successive year. Ryuichi Sakamoto composed the music to add a sense of tension
and dignity to the film. This is one of the best films in history created by the greatest actors and staff.
“The Revenant was shot only with natural sunlight and fire without using any artificial lighting which did not exist in the era.
Top films always have value and we have paid for it, which has developed the motion picture industry.
“Cinema is an entertainment and you do not need to think of it too seriously. However we could disappoint the people
who are proud of working for the industry if we watch films illegally. So please tell them “It is not good”
when you find the people choosing not to watch the licensed version.
“The Revenant was released with a brilliant record behind it. It would be appreciated if you could recommend it
as a must-see masterpiece during the Golden Week to your family and friends, and let them know about the highlights of the movie.

According to information from the National Police Agency, 29 prefectural police in Japan conducted a nationwide simultaneous intensive crackdown on copyright infringement incidences of movies, music, animation, comics, and business software via file sharing software, etc. during the period of February 16th to 18th, 2016, and searched 93 premises. Up to the present time, 15:00 PM on February 19, 44 individuals have been arrested.

The Japanese National Police Agency has effectively continued to execute a Simultaneous Intensive Crackdown on Copyright Infringement Using File Sharing Software, etc. since the year of 2009, and this operation was the seventh time.
In addition to this, all ACA affiliate associations have participated in the operation of sending out warning messages via emails implemented by the Consortium against Copyright Infringement via File-Sharing Software (CCIF), and have joined the action of requesting individual users who commit distribution of copyright infringement content using file sharing software networks to delete the files.
Along with the National Police Agency, ACA will continue to work closely in conjunction with all relevant ministries and agencies in the future to promote the movement of eradicating counterfeit products and protecting intellectual property.

For the simultaneous intensive crackdown, JIMCA assisted in the operation by filing complaints against the individuals, who had illegally uploaded files of MPA member companies' copyrighted movies, to four prefectural police.
